My BCMR Case

I, Chauncey L. Robinson, will allow you to be able to review documented evidence of deprivation of my due process rights and civil rights by the United States Department of the Army, Army Review Boards Agency which operates under the jurisdiction of the Department of Defense. I served my country in the United States Military at Fort Leonard Wood, Mo, from January 7, 1992 thru July 7, 1992. During my active duty military service, I was injured and requested both a Medical Evaluation Board (MEB) and Physical Evaluation Board (PEB), which I was deprived of my due process rights to be medically examined by either or both of those two boards. And also my request for hearings concerning the issues of deprivation of both (MEB) & (PEB), while I was still on active duty. Therefore when I received an honorable discharge, once I got home and learned of a stigmatizing separation code in my DD Form 214, I filed a claim with the U.S. Department of the Army, Army Review Boards Agency for my military retirement and correction to my DD Form 214, SPN code, which said I was PREGNANT.

Therefore have been several new policy changes for the benefit of Veterans that procedural violations due to bad paper military discharges, such as follows: September 3, 2014, the Secretary Of Defense issued a Memorandum For Secretaries Of the Military Departments concerning military discharges. The new guidance clarifies that the liberal consideration policy includes conditions resulting from post-traumatic stress disorder, traumatic brain injury, sexual assault or sexual harassment, said Air Force Lt. Around November 2011, again I submitted the “Lester F. Casey V. The United States, No. 528-80C, May 13, 1985 and Neil Wilhelmus, Plantiff, V. Peter Green, Defendant, Civil Action No. 90-662 (JEB), July 13, 2011, which required correction of the stigmatizing code in  my DD Form 214. Which has been continuously denied and is presently pending before the Department of the Army, Army Review Boards Agency. Even after U.S. Claims Court, Judge Yock ruled in favor Veterans, that records are to be corrected and they’re to receive their benefits for that period of active duty service and voluntary retirement in the pay grade of discharge: Lester F. After having filed for reconsideration several times, especially on January 21, 2011, I received a letter dated September 12, 2011, from the Department of the Army, Army Review Boards Agency, which reads as follows on page 2, “In regards to your statement that you received a separation program designator code for pregnancy, you can apply to the ABCMR to correct this specific alleged administrative error which is item 26 (SEPARATION CODE) of your DD Form 214, Certificate of Rlease or Discharge from Active Duty with a separation date of July 7, 1002. For 27 years all I’ve ever heard from both governmental agencies, U.S. Department Of  The Army, Army Review Boards Agency and U.S. Department Of Veterans Affairs, we’re in backlog, we’re short of man power.

The new excuse, I’ve been told as far as January 2019, the U.S. Department Of  The Army, Army Review Boards Agency was suffering a backlog due to last years government shutdown. 

And then I received the following letter from Senator Timothy Kaine’s office concerning a letter of response his office received from the U.S. Department Of The Army, Army Review Boards Agency dated March 27, 2019: Senator Timothy Kaine, Army Review Boards Agency Response To Chauncey Robinson, March 27, 2019

After not receiving any responses from no one about my military retirement, on January 20, 2020, I sent a letter to Senator Timothy Kaine’s office via email, requesting that in his capacity, as a member of the Armed Services Committee to get the Department Of The Army, Army Review Boards Agency to get a final resolution concerning my military retirement case: Senator Timothy Kaine, Chauncey L. On February 7, 2020, 2020, I received a letter from Senator Timothy Kaine’s office dated February 4, 2020, attached with a letter from the U.S. Department Of The Army, Army Review Boards Agency dated January 21, 2020, which reads as follows in paragraph two: “Case Management Division requested a medical advisory opinion from the Army Board for Correction of Military Records (ABCMR) medical staff. The issues presented requires a review with our medical staff, which has a delayed adjudication.” Department Of The Army, Army Review Boards Agency, January 21, 2020 & Senator Timothy Kaine, February 4, 2020

I will doing a follow up letter concerning responding to the Department Of The Army, Army Review Boards Agency letter dated January 21, 2020, concerning paragraph two.
